EO: On 2/9/2026, Petitioner filed a 1 Petition for writ of habeas corpus pursuant to 28 U.S.C. § 2241 ("Petition"), which requests that the Court order Respondents to show cause why this Petition should not be granted within 3 days. See ECF No. 1-1 at 3, 22. The Court notes that it retains discretion to determine when a response to a § 2241 habeas petition is due. See, e.g., 28 U.S.C. § 2254 Rule 1(b) ("The district court may apply any or all of these rules to a habeas corpus petition not covered by [28 U.S.C. § 2254]."); Clutchette v. Rushen, 770 F.2d 1469, 1474-75 (9th Cir. 1985) (concluding that, pursuant to Habeas Rule 4, the federal court has discretion to fix a time to file an answer beyond the time periods set forth in 28 U.S.C. § 2243). The Court, however, is mindful that habeas petitioners are entitled to a prompt ruling. See 28 U.S.C. § 2243 ("A court... entertaining an application for a writ of habeas corpus shall forthwith award the writ or issue an order directing the respondent to show cause why the writ should not be granted[.]" (emphasis added)); see also Fay v. Noia, 372 U.S. 391, 400 (1963) (explaining that a writ of habeas corpus is meant to provide a "swift and imperative remedy"). The Court thus DIRECTS Respondents to file a response to the Petition by 5:00 p.m. on 2/17/2026. Petitioner may file an optional reply by 9:00 a.m. on 2/19/2026.
