TEXT ORDER: In this matter, Petitioner alleges he is unlawfully detained under 8 U.S.C. § 1225(b)(2). Under this Court's decision in Valerio v. Joyce, Civ. No. 25-17225, 2025 WL 3251445 (D.N.J. Nov. 21, 2025), and in light of other recent decisions in this District interpreting § 1225(b)(2), the Court holds that Petitioner is subject to detention under § 1226(a). It is therefore ORDERED that, in accordance with 8 U.S.C. § 1226(a), within ten (10) days of the date of entry of this Text Order, Respondents shall provide Petitioner with an individualized bond hearing before an immigration judge who shall assess whether he presents a flight risk or a danger to the community... Within three (3) days of that bond hearing, Respondents shall file a written notice of the outcome of that hearing with this Court. The Government shall not transfer Petitioner out of New Jersey until this bond process is complete. If Respondents contend that Petitioner's detention is distinguishable from the cases in this district previously addressing §1225(b)(2), they shall file an expedited answer within seven (7) days of the date of entry of this Text Order, and Petitioner may file a reply within three (3) days of the date of filing of Respondents' expedited answer. So Ordered by Judge Zahid N. Quraishi on 2/9/2026. (kas) (Entered: 02/09/2026)

TEXT ORDER: The Court having reviewed Petitioner's recent request for discovery related to the fairness of his bond hearing (see ECF No. 7 ) and the related documents, Petitioner's request is DENIED WITHOUT PREJUDICE as the request appears to exceed the scope of the limited question of the fundamental fairness of Petitioner's own bond hearing currently before the Court. The Government shall provide a transcript or recording of Petitioner's bond hearing to the Court within seven days. Petitioner may file a new discovery request after The transcript has been provided to the extent Petitioner believes such is warranted upon review of the transcript. So Ordered by Judge Zahid N. Quraishi on 3/11/2026. (kas) (Entered: 03/11/2026)

TEXT ORDER: Currently pending before the Court is Petitioner's motion to enforce this Court order granting him a bond hearing. (ECF No. 5 .) According to EOIR's automated case information system, however, Petitioner's appeal of his order of removal was dismissed on March 3, 2026, and it appears that Petitioner is now subject to a final order of removal and mandatory detention under 8 U.S.C. § 1231(a), and that any challenge to his previous detention would now be moot. See Ufele v. Holder, 473 F. App'x 144, 146 (3d Cir. 2012). The parties shall therefore file an update with the Court within three days addressing whether Petitioner is now subject to a final order of removal and detention under § 1231(a), and whether his motion to enforce has therefore become moot. So Ordered by Judge Zahid N. Quraishi on 3/24/2024. (kas, ) (Entered: 03/24/2026)
