MINUTE ORDER. Petitioner filed a form petition for a writ of habeas corpus (AO 242) challenging his ongoing immigration detention. He alleges that his present detention under 8 USC 1225 is unlawful because he was previously released under supervision under 8 USC 1226. Although this is a familiar issue for the Court, the extremely cursory nature of the form petition makes it impossible for the Court to tell whether there are any differentiating facts, circumstances, or legal issues involved in this case. For instance, under Ground One of the petition, the petitioner explains that he was taken into custody after his removal proceedings were dismissed by an Immigration Judge, but does not explain why they were dismissed, how that affects his current status, and what, if any, significance this unique procedural posture has for his current custody challenge. While the form petition might be acceptable if petitioner was appearing pro se, he is represented by counsel. Accordingly, the Court orders petitioner to file an amended petition that details the facts and circumstances of his immigration status and present detention, and develops his legal challenges in more detail. This amended petition shall be filed on or before February 26, 2026. Once the petitioner has complied with this Order, the Court will issue an Order to Show Cause, directing respondents to file a response within a reasonable time. In the meantime, pursuant to Fed. R. Civ. P. 65(b)(1)(A), and in order to preserve the status quo, Respondents SHALL NOT TRANSFER petitioner outside the District of Colorado or remove him from the United States unless and until this Order is vacated by this Court or the Court of Appeals for the Tenth Circuit. by Judge R. Brooke Jackson on 2/12/2026. Text Only Entry (rbjlc9, ) (Entered: 02/12/2026)
