Judge Richard G. Stearns: ELECTRONIC ORDER entered re 10 Response filed by Kristi Noem, Patricia Hyde, Todd Lyons, Michael Krol. Parsing what is unsaid in Elicar Monzons bare bones habeas petition, the government contends that he "is subject to mandatory detention pursuant to 8 U.S.C. § 1225(b)(2) because he is an applicant for admission who has not been admitted to the United States and is not clearly and beyond a doubt entitled to be admitted to the United States." Resp. (Dkt #10) at 1-2. Even assuming petitioner is being held pursuant to 8 U.S.C. § 1226(a), the statute gives the Attorney General discretion whether to detain an individual or release him on bond "pending a decision on whether [he] is to be removed from the United States." Petitioner is ordered to show cause by October 10, 2025, why his continued detention is nonetheless unlawful and why this court has jurisdiction to entertain his request for release.
