District Judge Julia E. Kobick: ELECTRONIC ORDER TO SHOW CAUSE entered. The respondents are ORDERED to show cause, by September 22, 2025, why the petitioner should not be ordered returned to the District of Massachusetts for noncompliance with this Court's Order Concerning Service of Petition and Stay or Transfer of Removal. Specifically, this Court ordered, on 5:14 p.m. on September 15, 2025, that the petitioner not be removed from the District of Massachusetts unless the respondents have provided 72 hours' notice of that removal. ECF 4, at 3-4. The respondents stated in a status report that the petitioner was transferred out of the District of Massachusetts by a plane that "depart[ed] before this Court" issued that order. ECF 6, at 1. But the respondents did not provide evidence to support their claim—namely, a declaration specifying when the plane took off or flight data records. The petitioner, on the other hand, has provided evidence tending to suggest that his flight did not take off until 5:58 p.m. on September 15, 2025—44 minutes after this Court entered its order. ECF 8, ¶ 2; ECF 8-1. Accordingly, the respondents' response to this Order to Show Cause shall include, among other things, records that clearly specify the flight number and aircraft for petitioner's flight to Buffalo, New York; and a manifest for that flight, including the exact time the plane took off from the District of Massachusetts and the exact time it landed in New York. In response to this Court's Order to Show Cause, ECF 9, the respondents filed a Declaration of Assistant Field Office Director Keith Chan, ECF 12-1. But, invoking the law enforcement privilege, the respondents did not, as required by the Order to Show Cause, include more specific flight data records. ECF 12, at 2.
