MINUTES (IN CHAMBERS) ORDER RE EX P ARTE APPLICATION FOR TEMPORARY RESTRAINING ORDER AND REQUEST FOR SHOW CAUSE ORDER RE: PRELIMINARY INJUNCTION 3 by Judge Wesley L. Hsu. Because the issuance of a TRO or preliminary injunction is an extraordinary remedy, a petitioner requesting such relief bears the burden of proving its propriety. The Court finds that Petitioner failed to present any evidence to prove his burden that a TRO or preliminary injunction is warranted. The Court must therefore DENY the Motion in its current form. Joel Richlin: Now that the District Judge has ruled on Petitioner's Application for Temporary Restraining Order, the Court directs Respondents to file a response to the Petition no later than February 20, 2026. Respondents shall specifically address whether Petitioner is a member of the Bond Eligible Class certified in Maldonado Bautista v. Santacruz, No. 5:25-CV-1873-SSS-BFM, --- F. Supp. 3d ---, 2025 WL 3288403 (C.D. Cal. Nov. 25, 2025). Petitioner will then have until February 27, 2026 to file a response. The Court will then take the matter under submission without a hearing unless a hearing is specifically requested. See Fed. R. Civ. P. 78(b); C.D. Cal. L.R. 7-15. IT IS SO ORDERED.
