ELECTRONIC ORDER: Before the Court are Petitioner's motions to expedite consideration of his 28 U.S.C. § 2241 petition challenging his immigration detention (ECF Nos. 4, 18) and motions for immediate release from confinement (ECF Nos. 3, 19). The motions are DENIED without prejudice. These motions request, in essence, expedited consideration of the habeas petition due to Petitioner's alleged medical conditions that are not being "adequately treated" in detention and his other complaints about his conditions of confinement. See, e.g., ECF No. 3 at 2. Having reviewed the motions and the record, the Court finds that Petitioner has not demonstrated circumstances that meet the legal standard for expedited consideration. A motion for expedited consideration is reserved for situations where a delay would cause significant, irreparable harm that cannot be remedied through ordinary judicial process. Petitioner's conclusory filings fail to establish such irreparable harm. Further, Petitioner's motions overlook the Court's discretionary authority to set deadlines under Rule 4 of the Rules Governing Section 2254 Cases in the United States District Courts. See Castillo v. Pratt, 162 F. Supp. 2d 575, 575-77 (N.D. Tex. 2001); Beaird v. Joslin, 2006 WL 2473338, at *3 (N.D. Tex. Aug. 11, 2006), rec. adopted, 2006 WL 2459378 (N.D. Tex. Aug. 22, 2006). Given the sheer volume of habeas litigation recently filed by alien detainees, the Court is not inclined to set a precedent for shortening the established deadline for response without a demonstration of good cause. Petitioner has not provided sufficient evidence or argument to justify deviating from the Court's normal procedural schedule, especially considering that he has not complied with an order to refile his habeas petition on the Court-approved form and the undersigned has recommended dismissal of the case under Fed. R. Civ. P. 41(b). (Ordered by Magistrate Judge Rebecca Rutherford on 4/10/2026) (chmb) (Entered: 04/10/2026)
