ORDER denying 2 Motion for TRO Petitioner's Motion for Temporary Restraining Order is denied. The Motion seeks affirmative relief, rather than the mere preservation of the status quo. Moreover, to the extent that the Motion seeks to enjoin the transfer of Petitioner to another facility, the Motion fails to demonstrate a reasonably likelihood of success on the merits in that it is well established that district courts lack the jurisdiction to enjoin the transfer of a detainee. See e.g. Jane v. Rodriguez, 2020 WL 10140953 (D.N.J. May 22, 2020) (collecting cases). With respect to the request for a bond hearing, the Court will construe the Motion as one for preliminary injunction and will render its determination after considering the Respondents' submissions..
