(Text-Only) ORDER: Respondents are ordered to file a response to the Petition for Writ of Habeas Corpus 1 on or before February 9, 2026, at 11:00 a.m. CT, certifying the true cause and proper duration of Petitioner's confinement and showing cause as to why the writ should not be granted in this case. The response should include a reasoned memorandum of law and fact as well as any supporting documentation that may be needed to establish the lawfulness of Petitioner's arrest and/or continued confinement, including a response to each count of the Petition, a statement concerning immigration court jurisdiction over Petitioner, and a response concerning whether the absence of a warrant preceding Petitioner's arrest necessitates Petitioner's immediate release. No reply will be permitted, and the Court will decide the Petition without a hearing and based on the written submissions. Further, Respondents are temporarily restrained and enjoined from moving the Petitioner out of the District of Minnesota until the Court has issued a ruling on the pending Petition. If Petitioner has already been removed from Minnesota, Respondents are ordered to immediately return Petitioner to Minnesota as soon as possible and in any event no later than February 9, 2026. Violation of this order will result in consideration of any appropriate sanctions against the attorneys of record and the parties responsible for violating this order. Ordered by Judge Jeffrey M. (Text-Only) ORDER: The Court previously ordered counsel for Respondents to file, by February 11, 2026 at 11:00 a.m., a status update affirming that Petitioner was released without conditions. 6 Respondents did not comply with the Court's order in several respects. First, Respondents did not timely file the required status update or the required declaration. Second, Respondents acknowledge that they did not comply with the Court's order requiring them to return all property of Petitioner to Petitioner upon release (or, if any is retained, that they state which property is retained, the legal basis for its retention, and affirm that Respondents duly provided Petitioner with certified copies of any and all immigration-related documentation). Third, Respondents' update also appears to provide an incorrect date of release 10, and although Respondents state Petitioner was released without conditions, Respondents did not comply with the Court's order requiring documentation of Petitioner's release without conditions. Petitioner subsequently filed a Motion to Show Cause 8 and Motion to Enforce Judgment 9, in which Petitioner alleges that, contrary to this Court's Order 6, she was released subject to several conditions, including electronic monitoring and other conditions of an Intensive Supervision Appearance Program. Counsel for Respondents is ORDERED to file a status update by 11:00 a.m. on February 12, 2026, affirming Petitioner's release without conditions, along with supporting documentation. In addition, Respondents and counsel for Respondents shall cure all remaining noncompliance with the provisions of the Court's previous Order 6 on or before 11:00 a.m. on February 12, 2026.
