MINUTE ORDER (Text Only Entry) The Court has reviewed the papers filed thus far in this matter, including the motion for a temporary restraining order. (Doc. 12 .) On this record, it appears that Petitioner may be able to succeed on the argument that her detention violates due process for the reasons set forth in the district court cases that have addressed similar matters since the issuance of Matter Yajure Hurtado, 29 I&N Dec. 216, 220 (BIA 2025). See, e.g., Lopez-Arevelo v. Ripa, No. EP-25-CV-337-KC, ___ F. Supp. 3d ____, 2025 WL 2691828, at *7 (W.D. Tex. Sept. 22, 2025); Singh v. Lewis, No. 4:25-CV-96-RGJ, 2025 WL 2699219 (W.D. Ky. Sept. 22, 2025); Chafla v. Scott, No. 2:25-CV-00437-SDN, 2025 WL 2688541, at *7 (D. Me. Sept. 21, 2025); Pico v. Albarran, No. 25-CV-8002 JST (JSC), 2025 WL 2689860, at *3 (N.D. Cal. Sept. 19, 2025); Barrera, v. Tindall, 3:25-CV-541-RGJ, 2025 WL 2690565, (W.D. Ky. Sept. 19, 2025); Vazquez v. Feeley, No. 2:25-CV-01542-RFB-EJY, 2025 WL 2676082 (D. Nev. Sept. 17, 2025). However, the Court, which is among the busiest in the nation, cannot absorb the 12-day delay between the filing of the Petition and the request for a temporary restraining order, so will set a briefing schedule on the matter that permits Respondent to be heard and affords the Court sufficient time to consider these complex matters. Thus, pursuant to 28 U.S.C. § 2243, Respondents are ordered to show cause in writing no later than noon on October 8, 2025 why the Court should not grant Petitioner's motion for injunctive relief. Petitioner may file a reply no later than noon on October 15, 2025. The Parties are further ordered to appear for a hearing on the motion before the undersigned at 9am on October 23, 2025 via Zoom videoconference (details to be provided to the parties prior to the hearing). Alternatively, the Court would be amenable to ruling on the papers if the parties indicate that they are willing to waive a hearing.In the meantime, unless and until the Court orders otherwise, the Court ORDERS that Respondents shall not remove Petitioner from the United States nor transfer Petitioner out of this District. See F.T.C. v. Dean Foods Co., 384 U.S. 597, 604 (1966) (noting the court's "express authority under the All Writs Act to issue such temporary injunctions as may be necessary to protect its own jurisdiction"). Given the exigent circumstances, the Court finds that this order is warranted to maintain the status quo pending the hearing and any subsequent order and finds that Petitioner has satisfied the factors governing the issuance of such preliminary relief.No later than tomorrow, September 24, 2025, to the extent not already accomplished, Petitioner's counsel is directed: (1) to serve respondents with a copy of the Petition, the motion for temporary restraining order, and accompanying papers, along with a copy of this Order, by e-mail to all appropriate recipients including the United States Attorney's Office for the Eastern District of California and by overnight mail; and (2) promptly file proof of such service on the docket.
