Based on the foregoing, and on all of the files, records, and proceedings herein, IT IS HEREBY ORDERED THAT: 1. Petitioner's amended petition for habeas corpus 4 is GRANTED. 2. The Court DECLARES that petitioner is not subject to mandatory detention under 8 U.S.C. § 1225(b)(2). 3. If petitioner is in Minnesota, respondents must immediately release petitioner from custody.
