Judge Brian E. Murphy: ELECTRONIC ORDER entered. Respondents acknowledge that the facts presented in this case are “materially indistinguishable" from those recently considered by the Court in Diaz Martinez v. Hyde, No. 25-cv-11613-BEM, 2025 WL 2084238 (D. Mass. July 24, 2025), and Aguiriano Romero v. Hyde, No.25-cv-11631-BEM, 2025 WL 2403827 (D. Mass. August 19, 2025), and that “this Court’s prior decisions control the result in this case if the Court adheres to those decisions." Dkt. 9 at 1-2, 6. Accordingly, for the reasons stated in those cases, the Petition is GRANTED in part.
