Judge Indira Talwani: Judge Indira Talwani: MEMORANDUM AND ORDER entered.Accordingly, Petitioner's detention is governed by Section 1226. See Jennings, 583 U.S. at 289. Petitioner is thus entitled t o a bond hearing at which the government must "either (1) prove by clear and convincing evidence that she poses a danger to the community or (2) prove by a preponderance of the evidence that she poses a flight risk." Hernandez-Lara v. Ly ons, 10 F.4th 19, 41 (1st Cir. 2021). Accordingly, the Petition for Writ of Habeas Corpus [Doc. No. 1 ] is GRANTED as follows: No later than October 27, 2025, Petitioner must be provided a bond hearing pursuant to 8 U.S.C. § 1226 or, if the the immigration judge declines to conduct a bond hearing based on Matter of Yajure Hurtado, 29 I&N Dec. 216 (BIA 2025), Respondent shall so advise the court so that this court may conduct the bond hearing. Any decision by the immigration judge to retain Petitioner in custody following a bond hearing pursuant to 8 U.S.C. § 1226 shall set forth the reasons for the continued detention.IT IS SO ORDERED.
