ORDER re 5 Motion for Temporary Restraining Order by JOHN PAWANDEEP. In the 5 Motion, Petitioner seeks, inter alia, his immediate release from custody. Given that Petitioner is requesting affirmative relief rather than maintenance of the status quo, Petitioner's request goes beyond the limited, temporary nature of a TRO and requires giving Respondents notice and an opportunity to be heard. See Hope v. Warden York County Prison, 956 F.3d 156, 162 (3d Cir. 2020). Here, Petitioner has not yet complied with the Court's 4 Case Management Order requiring him to serve the United States Attorney's Office for the Western District of Pennsylvania by email and then file a certificate of compliance on the docket. ORDER AMENDING 4 Case Management Order. The Court has reviewed the Petition and supporting materials, and finds that the threshold issue concerns whether Petitioner is entitled to a bond hearing because he is subject to discretionary detention pursuant to §1226(a) as opposed to mandatory detention pursuant to §1225(b). Based on its prior decisions on this issue, including Gbamoi v. Oddo et al., Civil Action No. 26-cv-108-CCW, ECF No. 10 (W.D. Pa. Feb. 20, 2026) and Orellana Rivas v. Oddo et al., Civil Action No. 26-cv-246-CCW, ECF No. 8 (W.D. Pa. Feb. 23, 2026), the Court tentatively intends to grant the Petition to the extent it requests a bond hearing. Accordingly, IT IS HEREBY ORDERED that the 4 Case Management Order provisions regarding the timing and substance of Respondents' Response to the Petition are amended as follows: If Respondents believe that there are factual or legal differences between this case and the other cases in which the Court has decided the issue, then they shall file a response to the Petition on or before 3/6/26. Responses are limited to 25 pages, double-spaced. If Respondents' positions are the same as in the prior cases in which this issue has been raised and decided by the Court, they shall simply state as much in the 3/6/26 response, cite to any response or brief previously filed on the issue in this Court, and their positions shall be deemed to be incorporated by reference into the record. ORDER. On 2/2/2026, Petitioner filed a 1 Petition for Writ of Habeas Corpus requesting his immediate release from custody or, in the alternative, an individualized bond hearing pursuant to 8 U.S.C. Section 1226. The 1 Petition avers that Petitioner is currently detained at the Moshannon Valley Processing Center. See ECF No. 1 at 2. However, ICE's publicly available online detainee locator system did not return any results for Petitioner's name or A-number when searched on 3/9/26 by the Court. Thus, it appears to the Court that Petitioner is no longer in ICE custody, thereby rendering the 1 Petition moot. Accordingly, IT IS HEREBY ORDERED that, on or before 3/11/2026, the parties shall confer and file a joint status report regarding whether Petitioner remains in ICE custody and whether the 1 Petition is moot.
