ORDER by District Judge Margaret I. Strickland. The Verified Emergency Petition for Writ of Habeas Corpus states that Petitioner Valentina De Los Angeles Tiapa Moreno is a material witness to an alleged crime committed by U.S. Immigration and Customs Enforcement Officers in Minnesota. ECF No. 1 para. 1. The Minnesota Bureau of Criminal Apprehension has agreed to sponsor Petitioner for U Visa status, and a Minnesota court has ordered that she not be removed from the country. Id. paras. 1, 15. Regardless, Respondents have accelerated her regularly scheduled August 2026 immigration hearing to tomorrow, February 6, 2026, and shuffled her from Minnesota to Texas, and now to New Mexico. Id. para. 1. On February 4, 2026, Petitioner filed her 1 Verified Emergency Petition for Writ of Habeas Corpus in this District, and the Court has scheduled a remote Status Conference for today, February 5, 2026 at 11:15 am.Federal judges are empowered to certify U Visa petitions. See U Visa Law Enforcement Resource Guide at 3. "Judges may sign certifications based on a review of court records involving the victim." Id. "A judge may also sign based on having detected a qualifying crime during a proceeding (criminal or civil) over which they presided."
