Judge Richard G. Stearns: ELECTRONIC ORDER entered re 7 Response to Petition for Writ of Habeas Corpus - 2241, and motion to transfer petitioner filed by Kristi Noem, Patricia Hyde, Todd Lyons. Granting the governments motion to transfer this case to the District of New Hampshire as petitioner Julio Kanangila has been detained at FCI Berlin since his arrest by ICE in June of 2025. See Rumsfeld v. Padilla, 542 U.S. 426, 434-435 (2004) (an individual challenging his detention through a habeas petition must file that petition in the district where he is detained and must name the custodian detaining her in such district as the respondent). /// ENDORSED ORDER. Text of Order: The court assumes arguendo that petitioner is not a member of the class certified by Guerrero Orellana, Civ. no. 25-cv-12664-PBS, 2025 WL 3687757, at *10 (D. Mass. Dec. 19, 2025). Respondents nevertheless agree that the petitioner is entitled to a bond hearing as a matter of due process if the court applies Judge Elliott's reasoning in Destino v. FCI Berlin, Warden, Civ. no. 25-cv-374-SE-AJ, 2025 WL 4010424 (D.N.H. Dec. 24, 2025). The court finds Destino persuasive and applies it. The petition (doc. no. 1) is therefore granted. Respondents are ordered to provide the petitioner with a constitutionally adequate bond hearing before an IJ within 7 days. On or before February 14, 2026, respondents shall submit a filing informing the court of the result of the bond hearing. Status Report/Response due by 2/14/2026. So Ordered by Judge Landya B.
