MINUTE ORDER IN CHAMBERS of the Honorable Judge Jennifer A. Dorsey on 10/3/2025. Upon review of the parties' briefs concerning Vardan Gukasian's motion for a temporary-restraining order 5, the court concludes that a hearing on the motion will be beneficial. That hearing is set for Tuesday, October 14, 2025, at 1:30 p.m. in Courtroom 6D of the Lloyd D. George Federal Courthouse, 333 Las Vegas Blvd. So., Las Vegas, Nevada 89101. This hearing will be conducted in person.In addition to the arguments raised in the briefs, the parties should be prepared to discuss:- Whether Gukasian's conditions-of-confinement claims can properly be brought in conjunction with his habeas claim. The parties must be prepared to address what entity, ICE or HDC, is responsible for Gukasian's medical care, visitation rights, and access to counsel while he is being detained, and whether ICE would have the authority to alter those conditions if ordered to do so. The parties should also be prepared to argue the merits of Gukasian's conditions-of-confinement claims in the event that the court revisits its prior ruling that those claims cannot be brought in this action. The respondents must be prepared to specifically address the effect of Roman v. Wolf, 977 F.3d 935 (9th Cir. 2020), on this court's jurisdiction to hear Gukasian's complaint for injunctive and declaratory relief alongside his habeas petition.- Whether Gukasian's medical condition and access-to-counsel concerns would be among the things that the immigration judge could consider in a bond-redetermination hearing based on materially changed circumstances under 8 C.F.R. 1003.19(e). The respondents should also be prepared to confirm that the bond proceedings under 8 U.S.C. 1226(a) and relevant regulations remain available to Gukasian, given ICE's new policy restricting bond availability to many, if not all, immigration detainees in custody pending removal and the Board of Immigration Appeals' recent decision confirming the department's interpretation of 8 U.S.C. 1125(b) and 1226(a). After hearing argument on the petitioner's motion for a temporary restraining order 51, the court requires supplemental briefing from the federal respondents and the petitioner. Those parties must file a supplemental brief by April 20, 2026, addressing the following issues:1. At the April 14, 2026, hearing, petitioner's counsel argued that petitioner's removal to Russia would obviate the need for detention because he would no longer be a risk to any communities within the United States. Would Russia's willingness to accept the petitioner amount to a "changed circumstance" that he could raise in another custody-redetermination motion before an immigration judge? If so, does the availability of that procedure satisfy due process?2. If the court were to grant the petitioner's TRO motion, does this court have the authority to order the petitioner to self-deport as a condition of his release?3. At the hearing, petitioner's counsel represented that travel arrangements have already been made to repatriate him to Russia. Petitioner is ordered to provide additional details of those arrangements, along with a declaration from an appropriate member of the Russian government attesting to the truth of those arrangements.4. The government is ordered to provide an explanation of the established procedures by which self-deportation is normally handled under circumstances like this one (i.e., the noncitizen is detained but offers to self-deport), and provide any statutory or regulatory authority governing this procedure.
