It is ORDERED and ADJUDGED that Clerk of Court shall send a copy of the Petition and this Order by e-mail to the United States Attorney for the Middle District of Florida (USAFLM.Orlando2241@usdoj.gov.) and Immigration and Customs Enforcement (attn Assistant Field Office Directors) (MIAAOR-Habeas-DG@ice.dhs.gov); and by certified mail to Kristi Noem, Secretary, Office of the General Counsel, United States Department of Homeland Security, 2707 Martin Luther King, Jr. Ave, SE, Washington, DC 20528; the Director of Enforcement and Removal Operations, Miami Field Office, 865 S.W. 78th Avenue, Suite 101, Plantation, FL 33324; and the Attorney General of the United States, 950 Pennsylvania Avenue NW, Washington, DC 20530. All costs of service shall be advanced by the United States. Respondents, within five days from the date of the Order, shall respond to the Petition, and SHOW CAUSE as to why the Petition should not be granted. In addition, Respondents shall address where Petitioner was detained on February 5, 2026, the date the Petition was filed. If Petitioner is removed from the United States, Respondents must file a notice within three days of Petitioner's removal. Petitioner must advise the Court of the Petitioner's current mailing address, including if Petitioner is released from custody. If Petitioner fails to do so, the Court may dismiss the action. The parties must mark for identification all transcripts, briefs, affidavits, and other documentary exhibits and, if more than one, submit a table of contents or index (with a title, description, and date of each document). It is ORDERED and ADJUDGED that the Petition for Writ of Habeas Corpus (Doc. 1) is GRANTED. Respondents, and all other persons or entities acting in active concertor participation with them, are DIRECTED to immediately release Petitioner Juan Carlos Flores Marcia. Respondents, and all other persons or entities acting in active concert or participation with them, are PERMANENTLY RESTRAINED and ENJOINED from detaining Petitioner Juan Carlos Flores Marcia under 8 U.S.C. § 1225. Respondents, and all other persons or entities acting in active concert or participation with them, are TEMPORARILY RESTRAINED and ENJOINED from detaining Petitioner Juan Carlos Flores Marcia under 8 U.S.C. § 1226(a) until at least April 21, 2026. If Respondents later detain Petitioner Juan Carlos Flores Marcia under§ 1226(a), Respondents are DIRECTED to release him within ten days of his detainer unless he is provided with a bond hearing before an immigration judge during that ten-day period.
