IT IS FURTHER ORDERED that counsel for Respondents file a notice of appearance within 3 days of the date of this Order, file and serve their response to the Motion for Temporary Restraining Order within 7 days of the date of this Order, and file and serve their answer to the Petition within 14 days of the date of this Order, unless additional time is allowed for good cause shown. Petitioner will then have 7 days to file a reply to both Respondents' response and answer. ORDER GRANTING PETITION FOR WRIT OF HABEAS CORPUS IT IS HEREBY ORDRED that Petitioner's Petition for Habeas Relief, (ECF No. 1 ), is GRANTED. IT IS FURTHER ORDERED that Petitioner must be released from detention within 24 hours. IT IS FURTHER ORDERED that the parties must file a Joint Status Report no later than February 23, 2026, to certify compliance with the Court's order. IT IS FURTHER ORDERED that Respondents are ENJOINED from re-detaining Petitioner unless Petitioner is provided with (I) written notice before a pre-deprivation bond hearing and (2) it is demonstrated, by clear and convincing evidence at a pre-deprivation bond hearing before a neutral decisionmaker, that Petitioner is a flight risk or a danger to the community such that physical custody is legally justified. ORDER GRANTING MOTION TO ENFORCE Accordingly, IT IS HEREBY ORDERED that Petitioner's Motion to Reopen Case and Enforce Judgment, (ECF No. 15 ), is GRANTED. IT IS FURTHER ORDERED that Respondents must, no later than May 13, 2026, remove the conditions requiring a virtual check-in every four weeks via phone application that tracks Petitioner's location via GPS, and any other condition involving location monitoring. Respondents are prohibited from imposing release conditions that substantially interfere with Petitioner's liberty without having established the reasonableness of those restrictions, by clear and convincing evidence, at a pre-deprivation hearing. IT IS FURTHER ORDERED that the parties must file a Joint Status Report regarding compliance with this Court's Order by May 14, 2026.
