ORDER. To protect the status quo and preserve this Court's jurisdiction, the Court GRANTS the Petition and the Motion only insofar as respondents are hereby enjoined from removing petitioner from the United States or transferring him out of Colorado unless or until this Court or the Court of Appeals for the Tenth Circuit vacates this order or the case is terminated. At this time, the Court takes no action with respect to the remainder of the relief sought in the habeas petition. MINUTE ORDER re: The Court has reviewed petitioner's 18 MOTION to Enforce 14 Order,,,,, filed by Deonicio Castillo Cabral this morning (March 6, 2026) at 9:58 a.m. The motion asks the Court to find that an ICE order requiring petitioner to appear at an agnecy office in Centennial, Colorado on March 10, 2026 between 8:00 a.m. and 3:00 p.m. for a "Check-In and Case Review" violates its Order. Petitioner argues that this was not a condition imposed by the Immigration Judge and therefore is contrary to this Court's order that ICE "SHALL NOT impose additional release conditions other than those ordered by the Immigration Judge." The motion relates that counsel have conferred, but that respondents oppose the motion. If the government wishes to make an argument as to why the new ICE condition does not violate the Court's Order, the argument must be made no later than 10:00 a.m. on March 9. 2026. by Judge R. ORDER denying 18 Motion to Enforce. Although the Court ordered ICE not to place release conditions on petitioner above and beyond those ordered by the Immigration Judge at his bond hearing, the Court did not mean to suggest that any summons or check-in ordered by ICE throughout his removal proceedings is prohibited. To the Courts understanding, following his release from detention and the transfer of his case to the non-detained docket at the Denver Immigration Court, petitioner was issued a Form G-56 check-in letter requiring him to meet one time with a deportation officer to provide certain information/documentation. The Court also understands that the Form allows petitioner to call the deportation officer to reschedule if he is unable to attend the scheduled appointment date. This seemingly routine and limited responsibility does not rise to the level of violating the Courts order against the imposition of additional release conditions, such as an ankle monitor or mandating regular check-ins, and is a difference in kind not merely degree from the cases cited by petitioner [ECF No. 14]. If ICE imposes more onerous conditions at the check-in appointment or in the future, petitioner may renew his motion, but on the facts before the Court now, the Motion is denied. By Judge R.
