MINUTE ORDER signed by District Judge Daniel J. Calabretta on 2/11/2026: The Court previously construed Petitioner's Petition for Writ of Habeas Corpus as a Motion for Temporary Restraining Order. (See ECF No. 6 .) Having reviewed the Response provided by Respondents (ECF No. 8 ), the Court finds that at this time Petitioner has not shown a likelihood of success on the merits. Based on the limited information available to the Court, Petitioner may have received a conviction constituting a violation of a state law relating to a controlled substance within the meaning of 8 U.S.C. § 1182(a)(2)(A)(i)(II). As such, Petitioner may be subject to detention under 8 U.S.C. § 1226(c)(1)(A). While this may be subject to further factual or legal argument, at this stage, Petitioner has not met his burden to show a likelihood of success on the merits. As such, IT IS HEREBY ORDERED that the request for emergency relief (ECF No. 1 ) is DENIED. This matter is REFERRED to the assigned Magistrate Judge for all further proceedings. IT IS SO ORDERED. The Federal Defender is directed to identify counsel to represent petitioner. The Clerk of the Court shall serve a copy of this order on the Federal Defender, Attention: Habeas Appointment. Within 7 days of this order, the appointing authority for the Eastern District of California shall identify counsel and send counsel's contact information to the undersigned's courtroom deputy Jonathan Anderson at janderson@caed.uscourts.gov, and counsel will be added as counsel for petitioner. If counsel is not a member of the Eastern District of California Criminal Justice Act ("CJA") Panel, the Court hereby authorizes them to serve as CJA counsel for petitioner for the duration of the proceedings in this Court pursuant to Local Rule 180(b)(1). Within 7 days of adding counsel for petitioner, petitioner's counsel shall file either a reply to the respondents' opposition to the petition for writ of habeas corpus (ECF No. 8 ) or an amended or supplemental petition.
