MINUTE ORDER issued by Courtroom Deputy for Chief District Judge Troy L. Nunley on March 25, 2026: This matter is before the Court on Petitioner's motion for temporary restraining order, as construed by the Court. (ECF No. 1, 6.) Respondents filed an opposition. (ECF No. 9 .) Petitioner's appointed counsel did not reply. The Court has reviewed the parties' papers and finds Petitioner has not carried his burden to show a likelihood of success on his claims that Respondents violated the Fifth Amendment Due Process Clause. See Winter v. Nat. Res. Def. Council, Inc., 555 U.S. 7, 20 (2008) (standard for temporary restraining order). Petitioner was previously removed; he is subject to a reinstated order of removal, thus, he is subject to detention under 8 U.S.C. § 1231. (ECF No. 9 at 1, 3.) Additionally, an immigration judge heard Petitioner's claims as to credible fear of removal to his home country. (Id. at 2.) It appears Petitioner's removal is significantly likely and this Court's Order not to transfer Petitioner out of this district is the only impediment to Petitioner's removal. Accordingly, Petitioner's Motion for TRO is DENIED. The Court will rule on the Petition for Writ of Habeas Corpus ("the Petition"). Respondents may file a response by March 30, 2026. Petitioner may file a reply by April 6, 2026. If the parties do not timely file, this Court will assume they rest on the record. This Court's Order not to transfer Petitioner out of the district remains intact pending this Court's order on the Petition. SO ORDERED. (TEXT ONLY ENTRY) (Deputy Clerk MDK) (Entered: 03/25/2026)
