MINUTE ORDER signed by District Judge Daniel J. Calabretta on 2/3/2026: The Court has reviewed Petitioner's Petition for Writ of Habeas Corpus (ECF No. 1 ). In light of Petitioner's request that the Court "order... immediate release or issue a TRO" the Court construes the Petition as also a Motion for Temporary Restraining Order. Respondents shall file any Opposition to the Motion for Temporary Restraining Order on or before February 6, 2026. Respondents should address whether they oppose conversion of the Motion for Temporary Restraining Order to a Motion for Preliminary Injunction. The matter is not set for a hearing though the Court may set one should it later be determined that a hearing is necessary. The Clerk of the Court shall serve a copy of this Order together with a copy of Petitioner's 1 Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 on the United States Attorney. MINUTE ORDER (Text Only Entry) issued by Courtroom Deputy for Magistrate Judge Sean C. Riordan on 3/10/2026: In a letter to the Court, petitioner has requested a copy of respondent's answer that was filed on February 10, 2026 in order to prepare his reply brief that was due on March 6, 2026. Respondent's answer fails to include a certificate of service demonstrating that it was properly served on petitioner in accordance with Local Rule 135(b)-(c). See ECF No. 10 . Based on respondent's failure to serve him, petitioner was unable to meet the Court's deadline. Accordingly, respondent is ordered to serve petitioner with a copy of the answer via overnight delivery and to file a Certificate of Service with the Court no later than March 11, 2026. Normally, the Court would order respondent's counsel to show cause why sanctions should not be imposed for failing to comply with the Local Rules. However, counsel for respondent who filed the answer is no longer representing respondent in this action. Therefore, an order to show cause will not issue at this time. However, the Court will commence show causing any attorney who fails to provide a certificate of service at the time of filing. MINUTE ORDER (Text Only Entry) issued by Courtroom Deputy for Magistrate Judge Sean C. Riordan on 3/10/2026: After being directed by the Court to do so, respondent submitted a Certificate/Proof of Service for the response that was initially filed on February 10, 2026. ECF No. 17 . However, this proof of service fails to comply with the Court's order because the response was deposited in the regular mail rather than sent via overnight delivery as required. Respondent's initial failure to serve the response has already caused one delay in this case by necessitating an extension of time for the filing of petitioner's reply brief. The Court will not countenance any further delays in this case due to respondent's errors. Therefore, respondent shall promptly, but no later than March 11, 2026, serve petitioner with a copy of the response via overnight delivery and file a Certificate of Service indicating compliance with this order.
