ORDER TO SHOW CAUSE - Therefore, IT IS HEREBY ORDERED that the IFP application (ECF No. 1) is GRANTED. IT IS FURTHER ORDERED that the motion for appointment of counsel (ECF No. 2 ) is GRANTED. The Federal Public Defender for the District of Nevada is appointed to represent Petitioner Henriquez-Osorio and is directed to file a notice of appearance (or indicate its inability to represent Henriquez-Osorio) within 3 days of the date of this Order (by February 5, 2026). If the Federal Public Defender is unable to represent Henriquez-Osorio, because of a conflict of interest or for any other reason, alternate counsel will be appointed. Appointed counsel will represent Henriquez-Osorio in all federal proceedings related to this matter, including any appeals or certiorari proceedings, unless allowed to withdraw. IT IS FURTHER ORDERED that Petitioner, with the assistance of appointed counsel, file an Amended Petition by February 9, 2026. MINUTE ORDER IN CHAMBERS of the Honorable Judge Richard F. Boulware, II on 3/2/2026. Before the Court is Respondents' Motion to Extend Time (ECF No. 18 ). Through it, Respondents seek until March 6, 2026, to respond to Petitioner's 17 Supplement, filed February 25, 2026. Because Respondents did not previously seek leave from the Court to file a sur-reply in response to said Supplement, nor did the Court grant such leave, the Court also liberally construes the 18 Motion as a Motion for Leave to file a Sur-Reply. Counsel is advised that future motions for leave will be construed more strictly. The Court has reviewed the Motion, grants Respondents leave to file a sur-reply and finds that good cause exists for a deadline of March 4, 2026. The Court declines to grant further extension, as the Court does not find good cause for a longer extension at this time. In reaching this result, the Court relies on the following findings: 1. While the Court acknowledges Respondents' Counsel's significant case load, the Court notes that this case load is a direct result of Respondents' own conduct. 2. Petitioner's liberty is at stake in this case, and he has been detained for several months to-date. See generally ECF No. 9 (First Amended Petition for Writ of Habeas Corpus). As such, Petitioner is directly prejudiced by unnecessary delays in the resolution of this case. 3. This is a habeas matter. As such, this Court is required to promptly address Petitioner's claims. See Yong v. I.N.S., 208 F.3d 1116, 1120 (9th Cir. 2000) (citation omitted). Therefore, IT IS HEREBY ORDERED Respondents' Motion (ECF No. 18 ) is GRANTED in part and DENIED in part.
