TEXT ORDER: Petitioner has filed a Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241, in which she alleges that she is unlawfully detained under 8 U.S.C. § 1225. D.E. 1 ("Petition"). Under this Court's recent decision in Lomeu v. Soto, No. 25-16589, 2025 WL 2981296 (D.N.J. Oct. 23, 2025) (interpreting § 1225(b)(2)), this District's recent decision in Rivas Rodriguez v. Rokosky, No. 25-17419, 2025 WL 3485628 (D.N.J. Dec. 3, 2025) (interpreting § 1225(b)(1)), and other recent decisions in this District interpreting § 1225, the Court holds that Petitioner is subject to detention under § 1226(a), which entitles her to a bond hearing. It is ORDERED that, in accordance with 8 U.S.C. § 1226(a), Respondents shall, within 7 days of this Order, provide Petitioner with an individualized bond hearing before an immigration judge who shall assess whether Petitioner presents a flight risk or a danger to the community pursuant to 8 C.F.R. § 236.1(c)(8), (d)(1). Within 3 days of that bond hearing, Respondents shall file a written notice of the outcome of that hearing with this Court. If Respondents contend that Petitioner's detention is distinguishable from the cases in this District previously addressing § 1225, they shall file, within 5 days of this Order, an expedited answer, and Petitioner may file a reply within 3 days of the date of filing of Respondents' expedited answer. Pursuant to the All Writs Act, 28 U.S.C. § 1651, Respondents are enjoined from transferring Petitioner from New Jersey while this habeas proceeding is pending. TEXT ORDER - Before the Court is Petitioner's Motion for Order to Show Cause seeking to have this matter heard on an expedited basis. (ECF No. 4 .) By way of background, Petitioner was detained by Immigration Customs and Enforcement ("ICE") on December 3, 2025. (Id. at 3.) On January 31, 2026, Petitioner filed his Petition for Writ of Habeas Corpus ("Petition") under 28 U.S.C. § 2241. (ECF No. 1 .) On February 2, 2026, the Court ordered Respondents to file an answer within fourteen days of the date of the Court's Order to Answer. (See ECF No. 2 .) Petitioner now seeks an expediated decision in this matter based on his upcoming removal proceeding hearing, which Petitioner submits is scheduled for February 13, 2026 before the immigration court, and the medical condition his pregnant wife is experiencing. (See generally ECF No. 4.) The Court has considered Petitioner's § 2241 and the arguments made in his Motion for Order to Show Cause, and finds relief is warranted. It is ORDERED that Petitioner's Order to Show Cause (ECF No. 4 ) is GRANTED to the extent that the Court will order a bond hearing. It is further ORDERED that, in accordance with 8 U.S.C. § 1226(a), Respondents shall provide Petitioner with an individualized bond hearing before an immigration judge who shall assess whether Petitioner presents a flight risk or a danger to the community pursuant to 8 C.F.R. § 236.1(c)(8), (d)(1). It is further ORDERED that the bond hearing shall take place on February 13, 2026, prior to his February 13, 2026 immigration hearing if practicable and may be conducted by the Immigration Judge handling Petitioner's immigration hearing but shall be handled prior to the immigration hearing. If Respondents contend that a bond hearing prior to Petitioner's February 13, 2026 immigration hearing is not practicable or if Respondents contend Petitioner's detention is distinguishable from the cases in this District previously addressing § 1225, they shall notify the Court in writing by 3:00 p.m. on February 12, 2026.So Ordered by Judge Julien Xavier Neals on 2/11/2026.
