ORDER RE EMERGENCY APPLICATION FOR TEMPORARY RESTRAINING ORDER by Judge Stanley Blumenfeld, Jr. Ivan Garcia-Quiros has filed an emergency motion for a temporary restraining order (TRO). To preserve the status quo while the motion is being considered, the Court issues this interim order. THEREFORE, IT IS HEREBY ORDERED: 1. Respondents are ENJOINED from removing Petitioner Ivan Garcia-Quiros from the United States or transferring him outside the jurisdiction of the Central District of California until the Court adjudicates the pending TRO application. 2. (In Chambers) Order by Judge Stanley Blumenfeld, Jr.: Petitioner filed an ex parte application for a temporary restraining order (TRO) on January 31, 2026. Dkt. No. 1. On the same day, the Court issued an emergency order staying Petitioner's removal from the United States pending resolution of the TRO application. Dkt. No. 3. Petitioner promptly served the TRO application and the emergency stay order on Respondents. Dkt. No. 4. The case was then mistakenly transferred to another district judge and was reassigned back to this Court on February 12. The government shall file its opposition or statement of nonopposition to the TRO application by 5:00 p.m. on February 13, 2026.
