MINUTES OF PROCEEDINGS - Status Conference held on 10/17/2025 before Judge Richard F. Boulware, II. Crtrm Administrator: D. smith; Pla Counsel: Jeremy Mondejar for Petitioner; Def Counsel:, Cris Ruiz, Summer Johnson and Victoria Tomova for the Government; Court Reporter: J Moore; Time of Hearing: 9:54 - 10:24; Courtroom: 7CFederal Respondents have until Monday, 10/20/2025 to respond to the 23 Amended Motion for Preliminary Injunction as it relates to individual relief. Federal Respondents have until 10/31/2025 to respond to the 21 Amended Complaint and 23 Amended Motion for Preliminary Injunction as it relates to class wide relief. The deadline to respond the 22 Amended Motion for Class Certification is STAYED at this time. IT IS ORDERED that the 3 4 13 16 and 18 Motions are DENIED as moot due to Petitioners filing of the 21 Amended Complaint. IT IS ORDERED that this case is consolidated with Case No. 25-cv-1542 for the purposes of pre-certification class discovery ONLY. The Court appoints the following counsel as interim class counsel: (1) Jeremey Mondejar; (2) Daniel Lippman; (3) Karen Sarahi Monrreal-Salazar, subject to inquiry and interest of other counsel. The Court finds, in its discretion, that precertification discovery is necessary to identify putative class members so that the Court may order appropriate notice to putative class members in order to protect their interests and fairly conduct these actions. See Fed. R. Civ. P. 23(d)(1)(B). Additionally, the Court finds information, which is exclusively within the possession of the Department of Homeland Security (DHS), Executive Office for Immigration Review (EOIR), and Nevada Southern Detention Center (NSDC), is necessary and material to determine the existence of the class and whether it can be certified. Therefore, as dictated on the record, IT IS HEREBY ORDERED that Federal Respondents shall provide the following information to interim class counsel: (1)The number of individuals currently detained in ICE custody in the District of Nevada, including the facilities in Pahrump, Henderson, and Washoe County. (2)For each individual in ICE custody: a.Their name; b.Their A-File number and country of origin; c.The date on which they were detained; d.Copies of any arrest warrant, notice to appear (NTA), and initial custody determination issued by ICE/DHS; e.Whether or not they have requested a custody redetermination (bond hearing) hearing before and Immigration Judge (IJ); f.Whether or not they have received a bond hearing, and if not, the reason why they were denied a bond hearing; g.If they received a bond hearing, whether bond was granted or denied, and the reasons for the decision of the IJ; h.If bond was granted, whether the IJs decision was automatically stayed pursuant to 8 U.S.C. § 1003.19; i.If an automatic stay was invoked, whether 8 C.F.R. § 1003.6 has been fully complied with; j.Whether or not DHS is detaining the individual pursuant to 8 U.S.C. § 1225(b)(2). Federal Respondents shall file a status report by 10/22/2025 setting forth the number of individuals currently detained in ICE custody in the District of Nevada and the anticipated amount of time needed to obtain the above information. The parties are granted leave to seek additional precertification discovery. The parties are ordered to meet and confer and file a joint proposed scheduling order, including class certification briefing deadlines, and stipulated protective order, by 10/24/25. The Court makes preliminary remarks and hears from Respondents as to the status of DHS compliance with the Court ordered pre-certification discovery. As set forth on the record, IT IS ORDERED that on or before 11/05/25 the stipulated protective order be circulated and signed by counsel in Case Nos. 2:25-cv-01542-RFB-EJY, 2:25-cv-01553-RFB-BNW, and 2:25-cv-02136-RFB-MDC. IT IS FURTHER ORDERED that on or before 11/05/225 Respondents shall provide to putative class counsel in the above three actions the names, A numbers, and dates of detention regarding the 185 detainees identified by DHS as applicants for admission subject to the mandatory detention under § 1225(b)(2). Respondents shall provide the same information for the remaining 410 detainees identified by DHS as soon as feasible, on a rolling basis. IT IS FURTHER ORDERED that on or before 11/07/25, Respondents shall provide a list of how the sources of the requested information for each detainee are stored, accessed, and maintained, including but not limited to any arrest warrant, NTA, Form-286, and Form I-213, whether stored electronically, within the E-Cast system, or otherwise. Respondents shall also provide an exemplar of how these documents are stored for an individual detainee for the Courts review. IT IS FURTHER ORDERED that a status conference is set for 11/13/25 at 10:30 a.m., in LV Courtroom 7C, in all three putative class actions. IT IS FURTHER ORDERED that at least one representative from DHS/ICE who can describe how the agency identified the 185 detainees and how the requested information is stored, maintained, and retrieved shall appear at the 11/13/25 status conference. The parties shall be prepared to finalize a discovery and certification briefing schedule for all three putative class actions, which will be consolidated for purposes of pre-certification discovery, at the status conference.
