ORDER denying 5 Mr. Singhs motion for temporary restraining order. First, the motion is in the nature of more affirmative relief (i.e., not preserving the status quo), and so should be a preliminary injunction motion. Second, even then, the motion 5 does not identify how this Court has jurisdiction to consider what appears to be a question related to pending immigration proceedings. See, e.g., 8 U.S.C. § 1252, which provides judicial review of final orders of removal; Abdulrahman v. Ashcroft, 330 F.3d 587, 591 (3d Cir. 2003) ("A decision by the Board that an applicant is ineligible for asylum constitutes a final order of removal that may be subject to judicial review under Section 1252(a)(1)"); Khalil v. President, United States, 164 F.4th 259, 273 (3d Cir. 2026) (8 U.S.C. § 1252(b)(9) strips the District Court of jurisdiction, requiring Khalil to wait to raise his claims until he files a petition for review (PFR) of a final order of removal.)
