Judge Richard G. Stearns: ELECTRONIC ORDER entered. Brito v. Garland, 22 F.4th 240 (1st Cir. 2021), stands for the proposition that "generally speaking, a plaintiff's failure to exhaust his or her administrative remedies precludes the plaintiff from obtaining federal review of claims that would have properly been raised before the agency in the first instance." Id. at 255. Petitioner acknowledges the administrative exhaustion requirement in his response to the court's show cause order. He argues, however, that the requirement should be excused here because the Board of Immigration Appeals cannot address his constitutional claims and/or has already predetermined the result of any appeal. The court is not persuaded. Any adverse decision from the Board of Immigration Appeals would be appealable to the First Circuit, who can address the constitutionality of the standard applied by the Immigration Judge and is not alleged to have prejudged the merits.
