TEXT ORDER TO SHOW CAUSE.Before the Court is Petitioner's Emergency Motion to Show Cause. (Doc. #7.) Petitioner provides that on February 4, 2026, the Court ordered that he be immediately released. As of February 9, 2026, Petitioner is still detained in Freeborn County and he had been given no information from guards or immigration officers as to whether or when he would be released. (Doc. #7, p. 2.) As such, it is hereby ORDERED that (1) Respondents shall immediately release Petitioner from detention with all of his items and belongings, including his phone, identification, documents, and money; and (2) Respondents shall show cause, on or before February 11, 2026, why they should not be held in contempt for violating the Courts February 4, 2026, Order. TEXT ORDER: Before the Court is Respondents' Status Update. (Doc. #10.) Respondents provide that Agency Counsel at OPLA informed Respondents' Counsel about Petitioner having been released at 1830 CST on 2/2/26 in Minnesota. (Doc. #10, p. 1.) However, the information that Petitioner was released on February 2, 2026 is contradicted by Petitioner's Motion to Show Cause (Doc. #7) filed on February 9, 2026 that stated [o]n February 8, 2026, Petitioner's sister learned that Petitioner was still in Freeborn County, and had been given no information from guards or immigration officers as to whether or when he would be released.
