District Judge Angel Kelley: ELECTRONIC ORDER entered. On January 30, 2026, Petitioners filed Petition for Writ of Habeas Corpus, seeking to enjoin Respondents from “coerc[ing] [Petitioners] into “self-deportation” by the threat of detention.” [Dkt. 1 at 5]. Petitioners allege that “at their last check-in with ICE, on January 20, 2026, they were ordered removed and [were] told... to leave by March 15, 2026 or... be detained.” [Dkt. 1 ¶ 7]. Petitioners claim that “threat of detention if Petitioners do not remove themselves acts as a constructive restraint on their liberty” and the Petition is “therefore rope for decision and this court has jurisdiction over it.” [Dkt. 1 ¶ 13]. Respondents, however, contend that the Court lacks jurisdiction because Petitioners are not “in custody” as required to invoke habeas jurisdiction under 8 U.S.C. § 2241. Petitioners did not reply.On review of the Petition and Response, the parties are directed to submit supplemental filing limited to: (a) address “in custody” requirement for habeas jurisdiction in this case, and (b) explain factual and legal context of the removal order that Petitioners allege ICE entered against them. Petitioners are ORDERED to submit a memorandum by June 10, 2026. Respondents are ORDERED to submit a reply by June 17, 2026.(CEH) (Entered: 06/03/2026)
