Where Petitioner states that she is scheduled to attend divorce proceedings on February 17, 2026, during which custody of her daughter will be determined, see Petitioner’s Reply Brief at 5 Doc. No. 13, no later than February 16, 2026, E.J. must either be released (on conditions if Respondents so require) or be provided a bond hearing pursuant to 8 U.S.C. § 1226. If the immigration judge declines to conduct a bond hearing based on Matter of Yajure Hurtado. Respondents shall advise the court by that date so that this court may conduct the bond hearing. Judge Indira Talwani: ELECTRONIC ORDER entered: where the court's order [ 14 ] from this morning directing Respondents to provide a bond hearing no later than February 16, 2026, did not take into account the federal holiday on that date, and where Petitioner still has scheduled a divorce proceeding for February 17, 2026, at 8:30 a.m., the court grants Respondent's Motion to Modify Order [ 15 ] in part. The court modifies its Order as follows: Respondents shall release Petitioner no later than February 16, 2026, so that she may attend the divorce proceeding on the morning of February 17, 2026. Such release may include conditions if Respondents so require, including that Petitioner shall self-report to ICE following that divorce proceeding. If Respondents require Petitioner to self-report to ICE following the divorce proceeding, Petitioner shall thereafter (but no later than two days after the self-report date) be provided a bond hearing pursuant to 8 U.S.C. § 1226. If the immigration judge declines to conduct a bond hearing based on Matter of Yajure Hurtado, 29 I. & N. Dec. 216 (BIA 2025), Respondents shall promptly advise the court so that this court may conduct the bond hearing.
