EO 1: On January 30, 2026, Petitioner Jorge Luis Silva-Huete filed a petition for writ of habeas corpus pursuant to 28 U.S.C. Section 2241 (2241 Petition), seeking, among other things, "immediate release" from his alleged incarceration at the Federal Detention Center (FDC) in Honolulu, Hawaii. Dkt. No. 1 . The 2241 Petition names as Respondents, among others, the Warden of the FDC. Petitioner is instructed to forthwith serve on all Respondents, including the FDC's Warden and the U.S. Attorney's Office for the District of Hawaii, a copy of the 2241 Petition and this Entering Order. Petitioner shall then forthwith file proof of such service in this case. Upon review of the record, Respondents shall have until February 25, 2026 - 20 days from this Entering Order - to respond to the 2241 Petition and show cause why a writ of habeas corpus should not be granted. See 28 U.S.C. Section 2243 (allowing up to 20 days to respond "for good cause"); Wallace v. Heinze, 351 F.2d 39, 40 (9th Cir. 1965) (explaining that a court has "inherent power" to allow additional time to respond). Petitioner shall have until March 4, 2026 to file an optional reply. Should Petitioner fail to file proof of service as directed herein before the close of business on February 25, 2026, or otherwise fail to adequately explain the lack of such service, this proceeding shall be dismissed for failure to prosecute.
