Jan. 5, 2026), and other similar cases previously decided by this court, or indicate that the matter is not substantively distinguishable. Petitioners may file a Reply on or before 1/30/2026. MINUTE ORDER signed by District Judge Dena M. Coggins on 1/29/2026: On 1/25/2026, Petitioners Dougals Giovanni Guardado Ramos, Severiano Galvez Moreno, Heriberto Alvarez, and Fausto Dionico Mendez filed a 1 Petition for Writ of Habeas Corpus and 3 Motion for Temporary Restraining Order seeking their immediate release from detention. On 1/28/2026, Respondents filed a 7 Motion to Sever for Improper Joinder, contending that Petitioners "are four individuals who are not related to each other and each seeks to bring a challenge to his individual detention." Respondents note that "[j]oinder of multiple individuals will complicate th[e] effort" to minimize error in responding to the numerous immigration habeas petitions this court is currently receiving and argue that "the volume of cases means that the risk of unintended error is higher with any case that presents in an unusual posture, such as batched cases." (Doc. No. 7 at 2.) Having considered Petitioners' 1 habeas petition and 3 motion for temporary restraining order, Respondents' 7 Motion to Sever, and the unique circumstances presented by the influx of immigration related habeas petitions filed in this court, the court finds the joinder of Petitioners in one habeas action to be improper and GRANTS Respondents' 7 Motion to sever. Accordingly, the court ORDERS the Clerk of the Court to open three new cases for Petitioners (1) Severiano Galvez Moreno (1:26-cv-0747 DC SCR), (2) Herbierto Alvarez (1:26-cv-0748 DC SCR), and (3) Fausto Dionico Mendez (1:26-cv-0749 DC SCR). This case shall remain active as to Petitioner Douglas Giovanni Guardado Ramos only. Respondents shall file their response, as ordered by the court's 5 order, as to each individual Petitioner in their respective cases. Finally, Petitioners' counsel is advised that any future immigration related petitions that counsel may file on behalf of other petitioners shall be filed in individual petitions, rather than joined in one petition.
