TEXT ORDER Regarding 2 Motion for Preliminary Injunction and Temporary Restraining Order. Plaintiff requests the ex parte issuance of a preliminary injunction and temporary restraining order. The Court does not have the authority to issue an ex parte preliminary injunction. See Fed. R. Civ. P. 65(a). The Court is authorized to issue an ex parte temporary restraining order, but only in narrow circumstances. See Fed. R. Civ. P. 65(b)(1). Plaintiff has not satisfied the requirements of Fed. R. Civ. P. 65(b)(1)(B), nor is the Court likely to issue an ex parte temporary restraining order in circumstances like those present here anyway. The Court will, however, set a hearing on 2 Motions promptly upon proof of service by Plaintiff. Plaintiff is directed to effectuate service and file proof of same. Signed by Judge Stephen H.
