ORDER GRANTING IN PART 1 PETITION FOR WRIT OF HABEAS CORPUS. Petitioner's Petition for writ of habeas corpus is GRANTED IN PART with respect to Grounds One, Three, Four, and Five. However, as disposition of the constitutional claim asserted t herein would not materially alter the outcome of this case or the relief granted, the Court declines to reach Ground Two of the Petition. Respondents SHALL immediately release Petitioner from custody on reasonable conditions of supervision. Respondents SHALL file a declaration with the Court within twenty-four hours of this Order, confirming that Petitioner has been released from immigration detention and providing the date and time of his release. Respondents SHALL NOT remove Pe titioner to a country other than Vietnam without first providing him written notice and a meaningful opportunity to respond in a reopened removal proceeding before an immigration judge.
