MINUTE ORDER (Text Only Entry) The Court has reviewed preliminarily the papers filed thus far in this matter, including the motion for a temporary restraining order. (Doc. 2 .) On this record, the Court does not presently see a basis for immediate release but does see the need to temporarily enjoin Respondent from effectuating any third-country removal of Petitioner without notice and an opportunity to be heard. Thus, unless and until the Court orders otherwise, the Court ORDERS that Respondents shall not remove Petitioner from the United States nor transfer Petitioner out of this District. See F.T.C. v. Dean Foods Co., 384 U.S. 597, 604 (1966) (noting court's "express authority under the All Writs Act to issue such temporary injunctions as may be necessary to protect its own jurisdiction"). Given the exigent circumstances, the Court finds that this order is warranted to maintain the status quo pending the hearing and any subsequent order and finds that Petitioner has satisfied the factors governing the issuance of such preliminary relief.The parties are ordered to appear for a hearing on Petitioner's motion for a temporary restraining order (Doc. 2 ) on Monday, September 8, 2025, at 1:30 p.m. on Zoom (access information to be provided to the parties in advance). In addition, no later than today, August 29, 2025, Petitioner's counsel is directed: (1) to serve respondents with a copy of the petition, the motion for temporary restraining order, and accompanying papers, along with a copy of this Order, by e-mail to all appropriate recipients including the United States Attorney's Office for the Eastern District of California and by overnight mail; and (2) promptly file proof of such service on the docket. Counsel for respondents shall promptly enter notices of appearance. Respondents may file a responsive brief no later than noon on September 3, 2025. Petitioner may file a reply brief no later than 4:00 p.m. on September 4, 2025. Alternatively, should the parties reach a stipulation about the procedures for or a stay of any third country removal, the Court would be amenable to adjusting the briefing schedule and hearing the matter as a preliminary injunction on a non-emergency timeline signed by District Judge Jennifer L. MINUTE ORDER (Text Only Entry) Having reviewed preliminarily the entire record presented thus far, including many of the cited authorities, the Court concludes that it requires additional time to prepare for a hearing on the pending motion for injunctive relief (Doc. 2 ). Thus, that hearing is continued from Monday, September 8, 2025 to Friday September 12, 2025, at noon. In finding good cause for this continuance, the Court has considered the equities on both sides as well as the requirements of Fed. R. Civ. P. 65.
