MINUTE ORDER (Text Only Entry) Having considered the papers filed thus far in this matter and pursuant to 28 U.S.C. § 2243, Respondent is ordered to show cause in writing no later than 3:00 p.m. on September 2, 2025 why the Court should not grant petitioner's motion for a temporary restraining order (Doc. 2 ). Petitioner may file a reply no later than 3:00 p.m. on September 3, 2025. The Parties are further ordered to appear for a hearing on the motion on Friday, September 5, 2025, at 9:30 a.m. on Zoom (details to be provided to the parties prior to the hearing) before the undersigned.In the meantime, and unless and until the Court orders otherwise, the Court ORDERS that defendants shall not remove petitioner from the United States nor transfer petitioner out of this District. See F.T.C. v. Dean Foods Co., 384 U.S. 597, 604 (1966) (noting court's "express authority under the All Writs Act to issue such temporary injunctions as may be necessary to protect its own jurisdiction"). MINUTE ORDER (Text Only Entry) The evidence presented by petitioner via his counsel (Doc. 9), is that he left Bakersfield at about 11 a.m. on August 28, 2025 and arrived at the Victorville Airport at about 3 p.m., located in the Central District of California. The government attests that, he boarded the plane in Victorville at 2:15 p.m. (Doc. 11 at 2) Even ignoring the government's evidence, the Court notes as a fact of ready determination, that the southern border of this District nearest Victorville, California, is approximately 77 miles. Thus, there is no evidence to suggest that by the time his counsel attempted to file the petition and TRO at 12:58 p.m., that petitioner was still in this judicial district. The matter is ORDERED to be IMMEDIATELY TRANSFERRED to the Central District of California signed by District Judge Jennifer L. Thurston on August 29, 2025. MINUTE ORDER (IN CHAMBERS) ORDER ENTERING PRELIMINARY INJUNCTION AS TO RESPONDENTS TONYA ANDREWS, MOISES BECERRA, KRISTI NOEM, PAM BONDI by Judge Serena R. Murillo. Accordingly, the Court ORDERS as follows: 1. Respondents, their officers, agents, servants, employees, and attorneys, and other persons who are in active concert or participation with Respondents shall not remove Petitioner to a third country, i.e., a country other than the countries designated as the countries of removal in Petitioner's final order of removal, without written notice to both Petitioner and Petitioner's counsel in a language the Petitioner can understand. Following notice, Petitioner must be given a meaningful opportunity, and a minimum of ten (10) days to raise a fear-based claim for protection under the Convention Against Torture prior to removal. If Petitioner demonstrates "reasonable fear" of removal to the third country, Respondents must move to reopen Petitioner's removal proceedings. If Petitioner is not found to have demonstrated a "reasonable fear" of removal to the third country, Respondents must provide a meaningful opportunity, and a minimum of fifteen (15) days, for Petitioner to seek reopening of his immigration proceedings. 2. This Preliminary Injunction shall take effect immediately and shall remain in effect pending resolution of the merits of this case or further order of this Court. 3.
