ORDER. Respondents represented to this Court that Petitioner is under a final order of removal under 8 U.S.C. Section 1231. ECF 7 at 1. Respondents claim that Petitioner's 10 month detention is not unlawful under Zadvydas v. Davis, 533 U.S. 678 (2001) because "preparations are underway for [Petitioner's] removal to China." Id. at 4. Respondents lastly raise a concern to Petitioner presenting new arguments in a reply brief without having a chance to respond. Id. The Court, liberally construing the petition as properly raising a Zadvydas due process challenge, orders Petitioner to file any brief in support of his Zadvydas claim by 4/10/2026. Petitioner should address why removal is not significantly likely in the reasonably foreseeable future. Respondents may file a brief in response by 4/17/2026. Signed by Judge J.
