Noem, David Wesling, Todd M Lyons, Pamela Bondi, Michael Krol. Eduardo Isai Salazar Trujillo, a citizen of Guatemala who entered the United States on April 12, 2019, at the Texas border at El Paso, was detained by U.S. Immigration and Customs Enforcement (ICE) on January 27, 2026. Counsel for Salazar Trujillo filed a habeas petition on his behalf on January 28, 2026. The court ordered a stay of transfer or removal without 72-hour notice to the court and directed the government to respond to the petition by February 4, 2026. However, a bond hearing was scheduled for February 3, 2026.At the hearing, Salazar Trujillo withdrew his request for bond "because the Immigration Judge Christine Olsen was presiding over all bond hearings in Chelmsford Immigration Court... indicated that she was going to deny all bond request in cases similar to Petitioners i.e. based on Yajure-Hurtado [opinion]." As this court had yet to order a bond hearing, the relief that it can afford here, it does so now. In order for Salazar Trujillo to seek any further relief should a release on bond be denied, necessitates that he follow the appeals process, both before the Immigration Judge and the Bureau of Immigration Appeals (BIA), before, if necessary, an appeal to the First Circuit Court of Appeals. Accordingly, the court orders that ICE facilitate a bond hearing for Eduardo Isai Salazar Trujillo before an Immigration Judge (consistent with the standards outlined in Hernandez-Lara v. Lyons, 10 F.4th 19 (1st Cir. 2021)), as soon as practicable, but in no case more than seven days from the date of this Order (by 2/12/26). (MZ) (Entered: 02/05/2026)
