Judge Indira Talwani: ELECTRONIC ORDER granting Petitioner’s Emergency Motion for Clarification [ 11 ] in part as follows.In its Memorandum and Order [ 10 ], the court determined that the Mathews factors weighed in favor of relief, that Petitioner’s detention without a bond hearing violated his due-process rights, and that a bond hearing pursuant to 8 U.S.C. § 1226 was an appropriate and minimally invasive additional procedure to ensure those rights. Id. at 3–5. The court ordered Respondents to “return Petitioner to the District of Massachusetts within 72 hours of the docketing of this Order.” Id. at 5. The court ordered further that “Respondents shall release Petitioner from custody or, in the alternative, following Petitioner’s arrival in Massachusetts and no later than February 20, 2026, provide Petitioner with a bond hearing pursuant to 8 U.S.C. § 1226.” Id. Petitioner now seeks clarification of this order where Respondents released Petitioner but are also seeking a bond hearing, scheduled for February 19, 2026, at 10:00 a.m. See Pet. Mot. for Clarification [ 11 ]; see also Detainee Information [[11-1]]; Notice of Custody Redetermination Hearing [[11-3]].The court’s intent in providing alternatives in its order was to leave the determination of whether to hold a bond hearing with Respondents, but to ensure that any such bond hearing would occur here in Massachusetts where this court has jurisdiction. Accordingly, the court does not find that Respondents have forfeited the opportunity for an Immigration Judge to conduct a bond hearing.Where Respondents failed to return Petitioner to Massachusetts until this morning, however, and where Petitioner requests that the bond hearing be continued for seven days to give Petitioner’s counsel sufficient time to prepare the bond packet, the Motion for Clarification [ 11 ] is granted. The court’s February 20, 2026 deadline for any bond hearing is vacated. If Respondents seek to proceed with a bond hearing pursuant to 8 U.S.C. § 1226, such hearing shall be scheduled for no earlier than February 25, 2026. (SEC) (Entered: 02/18/2026)
