This is a text only entry; no document issued. ORDER granting in part and denying in part 7 Motion for TRO. Respondents shall not remove Petitioner from the United States until further order of the Court. A telephone hearing is hereby scheduled for Monday, February 9, 2026 at 9:30 A.M. Eastern Time to address the continuation of this Temporary Restraining Order. The Court finds the elements for a TRO have been met based on the following: Petitioner contends that while he is subject to a final order of removal, he has been granted deferred action on that removal, that the deferred action has not been vacated or revoked, but the deferred action is being ignored by Respondents, who intend to remove him imminently without following the law with regard to his deferred action. Although Petitioner may no longer be physically present within the Middle District, the Court finds that it has jurisdiction to issue this TRO given that he was present in the district when he filed his petition for habeas and Respondents cannot deprive the Court of jurisdiction by illegally attempting to remove him from the Court's jurisdiction. This TRO is being entered Saturday, February 7, 2026, at 12:58 P.M. It is being served electronically on counsel of record for Respondents.
