MINUTE ORDER signed by District Judge Daniel J. Calabretta on 1/28/2026: The Court has reviewed Petitioner's Petition for Writ of Habeas Corpus (ECF No. 1 ) and Motion for Temporary Restraining Order (ECF No. 2 ). The Court is contemplating ruling directly on the claims raised in the underlying 1 Petition for Writ of Habeas Corpus that overlap with those addressed in the Motion for Temporary Restraining Order, with the understanding that the Court will also consider any arguments made and exhibits submitted in support of the 2 Motion for Temporary Restraining Order. Respondents shall file any Opposition to the Motion for Temporary Restraining Order on or before February 2, 2026. Petitioner may file a Reply on or before February 4, 2026. Both parties should address whether they oppose the Court ruling directly on those claims in the petition that overlap with the Motion or, in the alternative, to conversion of the Motion for Temporary Restraining Order to a Motion for Preliminary Injunction. The matter is not set for a hearing though the Court may set one should it later be determined that a hearing is necessary. Petitioner's counsel is DIRECTED to send a copy of the petition and provide the Petitioner's full name and A number to the US Attorney's Office by January 28, 2026 at 8:00 P.M., at their email usacae.ecf2241-imm@usdoj.gov.
