ORDER (1) Counsel for Petitioner must immediately serve the Petition (Doc. 1 ) Respondents. (2) If not already issued, the Clerk's Office must issue any properly completed summonses. (3) The Clerk of Court must immediately transmit by email a copy of this Orderand the Petition to the United States Attorney for the District of Arizona, tothe attention of Katherine Branch, Melissa Kroeger, Lon Leavitt, and Theo Nickerson. (4) Petitioner's Petition for Writ of Habeas Corpus (Doc. 1 ) is granted. (5) Respondents must provide Petitioner a bond redetermination hearing within ten days or release him from custody under the same conditions that existed before his detention. (6) Respondents must provide a notice of compliance within three days of releasing Petitioner or providing him a bond hearing. ORDER: On 1/28/2026, the Court granted the Petition and ordered Respondents to provide Petitioner with a bond redetermination hearing. (Doc. 4 ). Counsel for Petitioner was ordered to serve Respondents and the Clerk's Office was directed to issue any properly completed summonses. On 1/29/2026, the Clerk's Office issued a deficiency notice advising that summonses for Respondents Christopher McGregor and Luis Rocha would not be issued as they were not named in the Petition. (Doc. 7.) On 2/2/2026, Counsel for Petitioner filed an Amended Petition substituting Respondents John Cantu and Unknown Warden with McGregor and Rocha (Doc. 8 ). The Court does not find that service of the Amended Petition on Respondents is warranted as the requested relief has already been granted. Therefore, IT IS ORDERED that the Amended Petition (Doc. 8 ), is dismissed, without prejudice to counsel filing a motion seeking additional relief if necessary. Ordered by Judge Sharad H.
