ORDER: Petitioner's Application to Proceed In Forma Pauperis (Doc. 2 ) is granted. Respondents Immigration and Customs Enforcement and the current or acting Field Office Director of the San Diego Field Office are dismissed. The Clerk of Court must substitute David R. Rivas as the Respondent for Warden of the San Luis Detention Facility; Todd Lyons as Respondent for the current or acting Director of the United States Immigration and Customs Enforcement; Kristi Noem as Respondent for the current or acting Secretary of the United States Department of Homeland Security; and Pamela Bondi as Respondent for the current or acting United States Attorney General. The Clerk of Court must serve a copy of the Summons, the Petition (Doc. 1 ) and this Order upon the United States Attorney for the District of Arizona, the United States Attorney and to Respondents by certified mail. Respondents Rivas, Lyons, Noem, and Bondi must answer the Petition within twenty (20) days of the date of service. Petitioner may file a reply within ten (10) days from the date of service of the answer. This matter is referred to Magistrate Judge Deborah M. ORDER: The Report and Recommendation (Doc. 18 ) is partially adopted and partially rejected, as set forth above. The Petition (Doc. 1 ) is granted as to Petitioner's request for a bond hearing, and denied as to Petitioner's request for im mediate release. Petitioner shall receive a bond hearing within seven (7) days of the date this Order is filed. In the alternative, the Government shall immediately release Petitioner under appropriate conditions of release. Respondents shall file a notice of compliance within two (2) days of Petitioner's bond hearing or release. Petitioner's Motions for Hearing (Docs. 16 , 17 ) are denied as moot.
