TEXT ORDER: The Petitioner has filed a Petition for Writ of Habeas Corpus (ECF No. 1 ) arguing that his arrest and continued detention by immigration officials ("ICE") is unlawful. Petitioner was detained by ICE on February 26, 2025. He had a bond hearing before an immigration judge on March 20, 2025. See ECF Nos. 22-1 & 22-2. At the bond hearing, the immigration judge found that Petitioner is a danger to the community and ordered that he remain detained pursuant 8 U.S.C. § 1226(a). On May 21, 2025, an immigration judge ordered that Petitioner be removed. See ECF No. 1 at ¶¶ 6, 26. Petitioner appealed his removal decision, and his appeal was denied on December 31, 2025. ECF No. 22-3. The Respondents assert that, with the final order of removal in place, on or around January 22, 2026, ICE sent a travel document request to the Consulate General of Angola to initiate the removal process. ECF No. 22 at 2; ECF No. 22-4. Having reviewed the parties' filings, the Court concludes Petitioner's Petition for Writ of Habeas Corpus must be denied. Under 8 U.S.C. § 1231, Petitioner's detention is lawful. Once his removal order became final, he became subject to mandatory detention for a 90-day removal period. See 8 U.S.C. § 1231(a)(2). As of the date of this Order, that 90-day period has not passed. Accordingly, Petitioner's Petition for Writ of Habeas Corpus is DENIED without prejudice. So Ordered by District Judge Melissa R.
