Judge Myong J. Joun: ELECTRONIC ORDER entered. Victor Hugo Roblero Martinez filed his petition for writ of habeus corpus on 1/27/26 alleging that he was arrested on 1/4/26 and is being unlawfully detained without a custody redetermination hearing in violation of the Fifth Amendment to due process. See Doc. No. 1. That same day, on 1/27/26, I ordered Respondents to answer or respond to the petition and to include “any relevant documents, including but not limited to Arrest Warrants, Notice of Revocations, Notice of Custody Determinations, Orders from Immigration Court, and Orders of Release on Recognizance.” See Doc. No. 4 . On 1/30/26, Respondents filed their response to the petition alleging that the petition has been insufficiently pled, citing to a recent decision by Judge Saylor in Chavez Lopez v. Moniz, Docket No. 26-cv-10078-FDS. Respondents did not produce any relevant documents pertaining to Mr. Roblero Martinez as ordered. On 2/2/26, Petitioner then filed a Proposed Order wherein he asserts that he “is a class member in the matter of Guerreo Orellana v. Moniz, [Doc.] No. 25-[cv-]12664[-PBS]. The petition fails to meet the standard required under Rule 8. The scant information in the petition regarding Petitioner and his circumstances, together with the Respondents’ failure to produce any relevant documents, leaves me unable to make determinations with regard to Petitioner’s detention or whether he is as asserted a member of the Guerreo Orellana class. For the foregoing reasons, Petitioner is directed to file an amended petition by 2/9/26, and Responders are directed to respond to the amended petition and to produce all relevant documents pertaining to Petitioner as previously ordered by 2/13/26. Judge Myong J. Joun: ELECTRONIC ORDER entered. In their Response to Amended Habeas Petition, Doc. No. 15, Respondents acknowledge that Mr. Victor Hugo Roblero Martinez (“Petitioner”) is a member of the class certified in Guerrero Orellana v. Moniz, No. 25-cv-12664-PBS, and that the legal issues presented in this petition are similar to those addressed in Hilario Rodriguez v. Moniz, 25−cv−12358. I incorporate by reference the reasoning in my September 18, 2025 Order granting bond in the Hilario Rodriguez case, 25−cv−12358 Doc. No. 22, and find that Petitioner is subject to Section 1226(a)’s discretionary detention framework and is thus eligible for bond. The Petition for Writ of Habeas is GRANTED. Respondents are ORDERED to provide Petitioner with a bond hearing under 8 U.S.C. § 1226(a) within 10 days of this Order. The Respondents are ENJOINED from denying bond to Petitioner on the basis that he is detained pursuant to 8 U.S.C. § 1225(b)(2). The Respondents are further ORDERED to file a status report within 24 hours of the bond hearing, stating whether Petitioner has been granted bond, and, if his request for bond was denied, the reasons for that denial.(SP) (Entered: 02/05/2026)
