TEXT ORDER TO ANSWER:On December 17, 2025, this Court granted habeas relief and ordered a bond hearing for Petitioner Jijin Huang in Civ. No. 25-18213. (Civ. No. 25-18213, ECF No. 7.) The Court closed the matter after Respondents provided a status update informing the Court that the immigration judge conducted a bond hearing and denied bond. (Id. at ECF Nos. 7-9.) Petitioner has filed a second habeas petition on January 26, 2026, alleging that he was denied due process in that bond hearing. (ECF No. 26-813, ECF No. 1.) A district court may only review whether the bond hearing was fundamentally unfair, see Ghanem v. Warden Essex Cnty. Corr. Facility, No. 21-1908, 2022 WL 574624, at *2 (3d Cir. Feb. 25, 2022), and lacks jurisdiction to review discretionary determinations underlying the immigration judge's bond decision. See 8 U.S.C. § 1226(e). Therefore, Petitioner's filing of a new habeas action is not a substitute for an appeal of the immigration judge's Order denying bond. Within 7 days, Respondents are ORDERED to provide a copy of the hearing transcript, exhibits, and a brief addressing the allegations in the current petition.
