(Text-Only) ORDER: Respondents are ordered to file an answer to the Petition for Writ of Habeas Corpus 1 on or before January 28, 2026, at 11:00 a.m. CT, certifying the true cause and proper duration of Petitioner's confinement and showing cause as to why the writ should not be granted in this case. The response should include a reasoned memorandum of law and fact as well as any supporting documentation that may be needed to establish the lawfulness of Petitioner's arrest and/or continued confinement, including a response to each count of the Petition, a response concerning whether immigration judges lack jurisdiction over Petitioner, and a response concerning whether the absence of a warrant preceding Petitioner's arrest necessitates Petitioner's immediate release. No reply will be permitted, and the Court will decide the Petition without a hearing and based on the written submissions. Further, Respondents are temporarily restrained and enjoined from moving the Petitioner out of the District of Minnesota until the Court has issued a ruling on the pending Petition. (Text-Only) CASE MANAGEMENT ORDER: 1. The attorneys of record shall appear at a status conference on Monday, April 13, 2026, at 1:00 p.m. in Courtroom 3B of the Warren E. Burger Federal Building and United States Courthouse, 316 N. Robert Street, St. Paul, Minnesota. 2. Should the parties file a written stipulation prior to 1:00 p.m. on Monday, April 13, 2026, affirming that all property has been returned to that petitioner, the Court will consider canceling the status conference. 3. In the event that Respondents claim any of Petitioner's property has been lost, the Court will consider canceling the status conference if the parties file a written stipulation prior to 9:00 a.m. on Monday, April 13, 2026, that includes the following five components: (1) a full list of the property at issue, including Forms I-77, I-216, and G-589 for that petitioner; (2) an acknowledgment of Respondents' inability to locate the property in question; (3) an acknowledgement that there are no additional steps Respondents can take to locate the property in question; (4) an agreement that Respondents will, on or before May 13, 2026, compensate Petitioner for the value of the lost property; and (5) if applicable, an agreement that Respondents will, on or before May 13, 2026, replace or provide certified copies of lost work authorization or other documents issued by the federal government.4.
