PAPERLESS ORDER denying Walner Pierre's 6 Motion for Leave to Proceed In Forma Pauperis ("Amended IFP Motion"). On August 26, 2025, we denied Pierre's 3 First IFP Motion as "legally insufficient," explaining that, "[a]lthough Pierre attached the required affidavit to his IFP Motion, he failed to provide a certified account statement showing the money he has (or doesn't have) in his inmate account." Order Requiring Payment [ECF No. 4] at 2; see also Rule Governing § 2254 Cases 3(a)(2) (requiring a § 2241 petitioner seeking to proceeding IFP to file "the affidavit required by 28 U.S.C. § 1915" and "a certificate from the warden or other appropriate officer of the place of confinement showing the amount of money or securities that the petitioner has in any account in the institution"). We ordered Pierre to file a corrected IFP Motion by September 25, 2025. See Order Requiring Payment at 2. But, in his Amended IFP Motion, Pierre's failed (yet again) to attach a certified account statement in accordance with Rule 3(a)(2). See generally Am. IFP Motion. We therefore DENY his Amended IFP Motion, and we reiterate that, on or before September 25, 2025, Pierre must either file a legally sufficient IFP Motion or pay the Clerk's $5.00 filing fee. His failure to do so will result in dismissal of this case without further notice. Signed by Judge Roy K. Altman on 9/10/2025. (gan) (Entered: 09/10/2025)
